Agreement to Terms

By downloading, installing, or using the Shot of the Dark mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Shot of the Dark is a coffee journaling application that allows you to:

  • Log and track your coffee consumption

  • Record ratings, tasting notes, and brew details

  • Track your coffee logging streaks

  • Receive personalized coffee recommendations

  • Access analytics and insights about your coffee preferences

Account Registration

Creating an Account

To use Shot of the Dark, you must create an account using a valid email address. You agree to:

  • Provide accurate and complete information

  • Maintain the security of your password

  • Notify us immediately of any unauthorized access

  • Accept responsibility for all activities under your account

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activity.

Subscription Plans

Available Plans

Shot of the Dark offers the following subscription tiers:

Starter (Free)

  • Log up to 10 coffees per month

  • Basic ratings and notes

  • Streak tracking

Enthusiast ($2.99/month or $23.99/year)

  • Unlimited coffee logs

  • Flavor profiles and brew recipes

  • Brew timer and basic analytics

Connoisseur ($5.99/month or $47.99/year)

  • All Enthusiast features

  • SCA Cupping scores

  • Data export and import

  • Advanced analytics

Billing and Renewal

  • Subscriptions are billed through your Apple ID account

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

  • Your account will be charged for renewal within 24 hours prior to the end of the current period

  • You can manage and cancel subscriptions in your App Store account settings

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the App after the price change constitutes your agreement to pay the new price.

Refunds

Refunds are handled by Apple according to their refund policies. We do not process refunds directly.

User Content

Your Content

You retain ownership of all content you create in Shot of the Dark, including coffee logs, notes, and ratings ("User Content").

By using the App, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the service.

Content Guidelines

You agree not to use Shot of the Dark to:

  • Upload illegal, harmful, or offensive content

  • Violate any applicable laws or regulations

  • Infringe on intellectual property rights

  • Attempt to gain unauthorized access to the App or its systems

  • Use the App for any commercial purpose without our permission

Intellectual Property

Our Property

Shot of the Dark, including its design, features, and content (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the App

  • Reverse engineer or decompile the App

  • Remove any copyright or proprietary notices

  • Use our trademarks without permission

Feedback

If you provide suggestions, ideas, or feedback about the App, you grant us the right to use such feedback without compensation or attribution.

Third-Party Services

Shot of the Dark integrates with third-party services including:

  • Supabase for data storage

  • RevenueCat for subscription management

  • Apple for app distribution and payments

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

Disclaimers

"As Is" Service

Shot of the Dark is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy or reliability of content

No Professional Advice

Shot of the Dark is for personal use and entertainment. The App does not provide professional advice regarding:

  • Health or nutrition

  • Financial investments

  • Business decisions

Coffee recommendations and analytics are based on your logged data and should not be considered professional guidance.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any:

  • Indirect, incidental, special, or consequential damages

  • Loss of data, profits, or business opportunities

  • Damages resulting from unauthorized access to your account

  • Damages resulting from interruption or unavailability of the service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any third-party rights

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting a notice in the App

  • Sending an email to your registered address

  • Updating the "Last Updated" date

Your continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of North Carolina, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Granville County.

Dispute Resolution

Informal Resolution

Before filing a legal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

Arbitration

Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Oxford, North Carolina.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights at any time.

By using Shot of the Dark, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service
